Salve gets Supreme Court’s stay on Gujarat HC proceedings in plot allotment controversy

The controversy pertaining to allotment of land to judges in Gujarat has now reached the Supreme Court. The Court today issued notice to the Gujarat High Court and the State of Gujarat after Harish Salve secured an early hearing in the matter.

As reported earlier, the Gujarat High Court has been witnessing stormy scenes after Acting Chief Justice, VM Sahai issued notice to twenty-seven former and sitting judges over certain land allotments.

Salve mentioned the matter at 10.30 am before Chief Justice HL Dattu. He said that the matter should be heard urgently as a three-judge Bench was constituted by the High Court in a jiffy on a day when the Acting Chief Justice was retiring.

He said that the exchange between the Acting Chief Justice and the Advocate General had greatly affected the standing of the institution and that the Supreme Court should intervene in the matter.

The Court relented and agreed to hear the case at 12.40 pm.

When the matter was taken up, Salve questioned the sudden urgency displayed by the Acting Chief Justice in hearing the matter.

“The allotment has been there for years. Why is this urgent suddenly?”

Senior Advocate KK Venugopal appeared for High Court Advocates Association and sought intervention, which was allowed. The Court issued notice to Gujarat High Court and State of Gujarat High Court and adjourned the matter for 4 weeks.
